Paediatric evidence for care proceedings, criminal cases and clinical negligence.

Our paediatricians provide expert evidence on non-accidental injury, childhood illness and the standard of care a child received. Send the issues and the hearing date. The search is free, and we take legally aided cases, including care proceedings.

I need for case.

What a paediatrician can answer.

  • Non-accidental injuryThe likely mechanism and timing of bruising, fractures or head injury, and whether they fit the account given, in family and criminal cases.
  • Clinical negligenceWhether a child’s illness was recognised and treated in time, and the effect of any delay. See medical negligence expert witnesses.
  • A child’s healthThe child’s condition, treatment and outlook, where it bears on the case.

What we need.

Send the issues, the court, the hearing date and any draft directions, and how the case is funded.

You get the CVs, fees and availability of paediatricians who can take the case. We check experts for registration and insurance, and once you instruct, a named case manager arranges the appointment and manages the instruction through to delivery of the report. Reports usually take 1 to 2 weeks, or 2 to 3 days when urgent. Timescales are estimates and depend on expert availability, the appointment and receipt of the relevant records.

Keep confidential papers back for now: in children proceedings, case information may go only to an expert the court has permitted, apart from preliminary enquiries (PD 25C paras 3.3 and 3.4).

Before the permission hearing.

You can make enquiries of a paediatrician before the court gives permission (PD 25C para 3.4), so send us the case now, without the family’s names.

In children proceedings in England and Wales you need the court’s permission before a paediatrician sees the child. In cases issued from 20 July 2026 the expert must also be a regulated expert unless an exception applies, and a GMC-registered doctor is one. Our reply gives the application the CV, availability and likely cost it must contain.

In a criminal case no permission is needed to instruct an expert. Send the charge and the next hearing date. In Scotland or Northern Ireland, tell us the court, and the paediatrician reports to its rules.

The full permission rules are on our family and care proceedings page.

Other experts.

Some questions about a child are for another specialty. Tell us every question in the enquiry, and we match each one to the expert it needs.

A GP expert

Where the claim is about a GP’s care of a child, breach of duty is judged against a responsible body of general practitioners. See GP expert witnesses.

An orthopaedic surgeon

For the prognosis of a child’s fracture or joint injury in a personal injury claim. See orthopaedic expert witnesses.

A psychiatrist or psychologist

On a parent’s mental health in care proceedings, or a child’s. See psychiatric expert evidence.

Can we contact a paediatrician before the court gives permission?

Yes: preliminary enquiries need no permission (PD 25C para 3.4). Send the case without the family’s names; we hold the case papers until permission has been granted.

Does the regulated expert rule apply to my case?

If the children proceedings were issued on or after 20 July 2026, yes, with limited exceptions (FPR 25.5A). A paediatrician on the GMC register is regulated by a UK statutory body, and the application must say whether the expert is regulated (PD 25C para 3.10(aa)).

Can a paediatrician act as a single joint expert?

Yes. Tell us at the start: in family proceedings the instructions go in a jointly agreed letter, with the fee shared between the parties (FPR 25.12).

Do you take legally aided cases?

Yes: the quotes come within the legal aid rates, and where the case justifies a higher rate the quote sets out why, ready for prior authority. See fees and legal aid for the rates in family cases.
