Medical evidence for employment tribunal claims.
Expert evidence on disability under the Equality Act 2010, psychiatric injury and fitness for work. Send the claim, the disputed issue and the preliminary hearing date. The search is free, whether the report is for one side or both.
What you get for a tribunal claim.
Start with the disputed issue and the preliminary hearing date.
Before the preliminary hearing
You get each expert’s CV, fee and availability, so you can see who can report before the hearing.
A joint report, if agreed
If the parties will instruct an expert jointly, say so in the enquiry, and we send CVs and fees you can put to the other side.
Through to the report
We check experts for registration and insurance. A named case manager arranges the appointment and manages the instruction through to delivery of the report. Reports usually take 1 to 2 weeks, or 2 to 3 days when urgent. Timescales are estimates and depend on expert availability, the appointment and receipt of the relevant records.
The disability test.
The tribunal decides disability; the expert gives the medical facts behind each part of the section 6 test.
- Impairment. Is there a physical or mental impairment, and what is it?
- Substantial. Is the adverse effect more than minor or trivial (s212(1))?
- Long-term. Has it lasted, or is it likely to last, at least 12 months or for the rest of the person’s life, or is it likely to recur (Schedule 1, para 2)?
- Without treatment. Would the impairment have that effect but for the treatment or measures being taken (Schedule 1, para 5(1))?
When the tribunal needs a report.
Not every disability claim needs one, as the Presidential Guidance on disability (Guidance Note 4) points out.
Medical evidence may be needed where there is a dispute about whether the claimant has a particular disability, or whether an impairment is under effective control by medication or treatment (Presidential Guidance, General Case Management, Guidance Note 4, paras 3 and 4).
If the respondent has not conceded disability, or says the condition is controlled by treatment, send the respondent’s position and the preliminary hearing date, and we find experts who can report before it.
Injury to feelings or psychiatric injury.
Injury to feelings and psychiatric injury are separate heads, and the second usually needs expert evidence.
The bands are from the Ninth Addendum to the Presidential Guidance (30 March 2026), issued by the Presidents of Employment Tribunals in England and Wales and in Scotland, for claims presented on or after 6 April 2026. In Scotland the bands remain subject to paragraph 12 of the original guidance of 5 September 2017. Industrial tribunals in Northern Ireland are not bound by this guidance.
If your client’s condition goes beyond injured feelings, send the claim and the hearing date, and we find a psychiatrist or psychologist who can report on diagnosis, causation and prognosis.
Which expert the claim needs.
An occupational health report advises the employer. An independent expert report is prepared for the tribunal, on the questions the parties or the tribunal set. For discrimination outside work (services, premises, education and associations), mostly heard in the county court or by the sheriff, see historical abuse and discrimination.
On fitness for work, the expert for the condition says whether your client could do the job, with or without adjustments, at the dates in issue. Put those dates in the enquiry.
Across the UK.
We find experts for tribunal claims in Scotland and Northern Ireland too. Tell us where the claim is.
England and Wales
- Equality Act 2010, s6 and Schedule 1
- Employment Tribunal Procedure Rules 2024
- Presidential Guidance on disability and on injury to feelings
Scotland
- The same Act and the same 2024 Rules apply
- For injury to feelings, the bands remain subject to paragraph 12 of the original guidance
Northern Ireland
- The Equality Act 2010 does not generally extend to Northern Ireland (s217)
- Disability is defined by the Disability Discrimination Act 1995 as it applies in Northern Ireland. It is a physical or mental impairment with a substantial and long-term adverse effect on the person’s ability to carry out normal day-to-day activities (s1(1)); Schedule 1, para 4(1) lists the capacities affected
- Claims go to the industrial tribunals, under their 2020 Rules of Procedure

Call 0121 752 6061Does my client need a medical report on disability?
Not always. Where the respondent disputes the disability, or whether the condition is controlled by treatment, medical evidence may be needed (Guidance Note 4, paras 3 and 4). Send the respondent’s position, and the CVs and fees follow.
Is anxiety, depression or PTSD a disability under the Equality Act?
It can be, if the impairment has a substantial and long-term adverse effect on your client’s ability to carry out normal day-to-day activities (s6(1)). The tribunal decides; the expert gives the diagnosis, the effects, the duration and the effect of treatment.
What is the time limit for a discrimination claim at work?
In England and Wales and Scotland, 6 months for acts on or after 1 October 2026, or for conduct extending over a period that ends on or after that date. Where that date is earlier, it is 3 months. The tribunal can allow such other period as it thinks just and equitable (Equality Act 2010, s123(1)). If the deadline is close, put it in the enquiry.
Do you find experts for industrial tribunal cases in Northern Ireland?
Yes. Tell us the claim: disability there is defined by the Disability Discrimination Act 1995 as it applies in Northern Ireland, not the Equality Act 2010.
